Gov. Cuomo’s executive order does not permit prepaying of school taxes

The Governor of the State of New York, Andrew Cuomo, recently issued Executive Order 172, which sought to facilitate the prepayment of property taxes by New York citizens before January 1, 2018.

The Governor’s Executive Order does not affect 2018-19 school year taxes, and was not intended to do so. 

Next school year’s taxes will not be determined, and cannot be presented to the public, until more than 30 days after the budget vote on the third Tuesday in May 2018.

That restriction is specifically written into law at Section 1318(2) of the Real Property Tax Law.

Simply put, the order does not authorize the prepayment of school taxes for the 2018-19 school year.
